Terms & Conditions

Last updated: 21 September 2026

These Terms are a launch draft and should be reviewed by a UK solicitor before live payments or commercial launch. SWAPUK is currently presented as the platform brand; the final legal entity name and company number should be added once the business is incorporated.

1. About SWAPUK

SWAPUK is an online marketplace platform that allows users to list, discover, discuss, swap and, where enabled, sell goods. Unless expressly stated otherwise, SWAPUK is not the owner of items listed by users and is not automatically a party to a sale or swap between users.

2. Acceptance

By creating an account, listing an item, making an offer, messaging another user or otherwise using SWAPUK, you agree to these Terms and the policies linked from the website.

3. Eligibility

SWAPUK is intended for users aged 18 or over. You must provide accurate information and must not create an account for another person without permission. We may restrict access where we reasonably believe an account is being misused.

4. Listings

5. Swaps

A swap is an agreement between the participating users. Users are responsible for agreeing what is exchanged, condition, collection or delivery arrangements and any additional cash payment. SWAPUK does not guarantee that a user will complete a swap.

6. Sales and traders

Users may sometimes sell goods through SWAPUK. Whether a seller is acting as a private individual or as a trader depends on the circumstances. Traders must comply with applicable consumer protection, pricing, cancellation, refund, product safety and other legal requirements. Nothing in these Terms removes statutory consumer rights that cannot legally be excluded.

7. Payments and buyer protection

SWAPUK may provide integrated online payments through third-party payment providers such as Stripe. Where payments are enabled, the checkout will show the item price, applicable SWAPUK fee and total before confirmation. Payment details are processed by the payment provider rather than stored by SWAPUK as raw card details.

For eligible sales, seller proceeds may remain pending after payment until the delivery, collection or buyer-protection conditions shown on the order are met. Buyers may confirm receipt or report a problem from My orders. If a problem is reported, seller payout may remain blocked while the case is reviewed. An automatic release window may apply where the order shows one. Payment services are also subject to the payment provider’s terms. SWAPUK may suspend or review a transaction where required for fraud prevention, legal compliance or payment-provider requirements.

Users must not deliberately move a transaction off-platform, provide false payment information, abuse refunds or chargebacks, or otherwise attempt to bypass a SWAPUK fee or payment control where the transaction is being completed through SWAPUK.

8. SWAPUK fees

SWAPUK may charge fees for listing, completing a transaction, promotion or other optional services. The applicable fee will be shown clearly before you become liable for it. Mandatory charges will not be hidden or added unexpectedly at the end of a transaction.

8.1 Collection and delivery listing fees

Delivery-only listings are currently free to publish. A listing that offers Collection, including a listing that offers both Delivery and Collection, may require a one-off Collection listing fee before the listing becomes active. This fee is intended to cover the cost of publishing a listing that can be completed through local collection.

The applicable amount is determined from the listing value at the time the fee is created. A listing requiring this fee remains pending until the payment is completed. If an existing Delivery-only listing is changed so that Collection becomes available, the Collection listing fee may become payable before the updated listing is activated.

8.2 Transaction fees

For eligible purchases completed through SWAPUK, a SWAPUK transaction fee may be added to the buyer's checkout total. The current fee schedule is:

The checkout will show the applicable item price, SWAPUK fee and total before payment is confirmed. Delivery or other optional charges, where applicable, will also be shown before confirmation.

8.3 Promotions and other charges

Promoted listings or other paid features may have separate charges. The price and nature of the charge will be shown before purchase.

8.4 Changes to fees

We may change future fees as the service develops. The fee applicable to a charge will be the fee shown before that charge is confirmed. We will not retrospectively increase a fee that you have already paid.

9. Prohibited conduct

You must not use SWAPUK for fraud, money laundering, harassment, threats, illegal transactions, intellectual-property infringement, abusive behaviour, attempts to bypass payment controls, or any activity that could harm users or the platform.

10. Messaging and user safety

Users must communicate respectfully and should not publish passwords, payment-card details or unnecessary sensitive information. SWAPUK may investigate reports of abuse, fraud or unsafe activity and may restrict accounts where appropriate.

11. Content and licences

You retain ownership of content you upload, but you grant SWAPUK a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and technically modify that content as necessary to operate, secure and promote the service. You confirm that you have the rights needed to upload the content.

12. Reviews and feedback

Reviews and feedback must reflect genuine experiences and must not be fake, manipulated, defamatory, threatening or misleading. SWAPUK may remove content that breaches these Terms or applicable law.

13. Suspension and removal

SWAPUK may remove a listing, cancel an offer, restrict features, suspend an account or terminate access where reasonably necessary to protect users, comply with law, address fraud or enforce these Terms. Where appropriate, we may provide a reason, subject to security, privacy and legal considerations.

14. Disputes between users

Users should first use the order protection tools where available and may contact SWAPUK through Support or Feedback. SWAPUK may request evidence, moderate the case and assist with payment-provider processes. SWAPUK does not guarantee that every dispute can be resolved or that a refund will be available in every case.

15. Limitation of platform responsibility

To the extent permitted by law, SWAPUK does not guarantee the identity, reliability, ownership, authenticity, legality, quality, safety or condition of every item or user. We are not responsible for a user's failure to complete a private transaction. Nothing in these Terms excludes or limits liability or statutory rights that cannot lawfully be excluded or limited.

16. Availability and security

We aim to keep SWAPUK available and secure, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates or security measures that temporarily affect availability.

17. Privacy

Our Privacy Notice explains how personal information is handled. You should read it before using the service.

18. HMRC and seller information

Where UK digital-platform reporting rules apply, SWAPUK may need to collect, verify and report seller information to HMRC. Users must provide accurate information when legally required.

19. Changes to these Terms

We may update these Terms when the platform, payment services or legal requirements change. The latest version will be published on this page with its update date. Where a change materially affects existing users, we will take reasonable steps to make the change clear.

20. Governing law

These Terms are intended to be governed by the laws of England and Wales, subject to any mandatory rights or protections that apply to you under applicable law.
